{"id":170488,"date":"2025-11-14T14:52:35","date_gmt":"2025-11-14T03:52:35","guid":{"rendered":"https:\/\/www.climatecouncil.org.au\/?post_type=resource&#038;p=170488"},"modified":"2025-11-18T16:53:31","modified_gmt":"2025-11-18T05:53:31","slug":"australias-environment-law-reforms-deliver-more-protection-pollution","status":"publish","type":"resource","link":"https:\/\/www.climatecouncil.org.au\/resources\/australias-environment-law-reforms-deliver-more-protection-pollution\/","title":{"rendered":"Will Australia\u2019s environment law reforms deliver more pollution than protection?"},"content":{"rendered":"\n<p>Right now, coal and gas corporations are building harmful projects across Australia, without their climate impacts being considered under our <a href=\"https:\/\/www.climatecouncil.org.au\/resources\/epbc-fixing-australias-national-environment-law\/\">national environment law<\/a>. The law ignores the climate damage that any new coal, oil or gas project built anywhere does to people, places and wildlife everywhere.&nbsp;<\/p>\n\n\n\n<p>The Albanese Government has an opportunity to fix this through its environment law reforms, currently being considered by Parliament. However, the Government\u2019s proposed reforms fail to meaningfully protect our environment from the ravages of climate pollution. This means that the 42 coal and gas projects already lined up for approval under our environment law could go ahead with no consideration of their climate impacts.&nbsp;<\/p>\n\n\n\n<p>These projects would add to the 32 new or expanded coal, oil and gas developments already approved by the Albanese Government since 2022. In total, these projects have disclosed expected annual emissions of nearly 13 million tonnes, equivalent to an extra 6 million cars on Australian roads every year.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.climatecouncil.org.au\/resources\/albanese-governments-fossil-fuel-approvals\/\"><strong>Learn more about the fossil fuel projects the Albanese Government has already approved.<\/strong><\/a><\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>More polluting projects in the pipeline<\/strong><\/h1>\n\n\n\n<p>There are at least 42 coal and gas projects currently in the pipeline for environmental assessment, with most of these actively seeking approval, and more than half of these applications made since 2023. Most are seeking approval to operate for decades, with about a third seeking to operate even beyond Australia\u2019s <a href=\"https:\/\/www.climatecouncil.org.au\/resources\/what-does-net-zero-emissions-mean\/\">2050 net zero target<\/a>.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/www.instagram.com\/p\/DQ77jaRDrAI\/?hl=en&amp;img_index=1\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"634\" src=\"https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/Screenshot-2025-11-14-at-2.48.19-pm-1024x634.jpg\" alt=\"\" class=\"wp-image-170492\" srcset=\"https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/Screenshot-2025-11-14-at-2.48.19-pm-1024x634.jpg 1024w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/Screenshot-2025-11-14-at-2.48.19-pm-300x186.jpg 300w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/Screenshot-2025-11-14-at-2.48.19-pm-768x476.jpg 768w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/Screenshot-2025-11-14-at-2.48.19-pm.jpg 1159w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/a><\/figure>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Unleashing millions of tonnes of climate pollution&nbsp;<\/strong><\/h1>\n\n\n\n<p>Estimated emissions are available for just 23 of the 42 projects in the queue for approval. These projects alone would emit an average of 8.7 million tonnes of pollution every year in the 2030\u2019s. This is nearly equal to the pollution from all of Australia\u2019s domestic flights every year (more than 600,000).<\/p>\n\n\n\n<p>These estimates do not take into account downstream emissions which are released when the coal and gas from these projects is burnt \u2013&nbsp;largely overseas. For every tonne of climate pollution released in Australia, the coal and gas industry \u2018exported\u2019 12.8 tonnes of climate pollution in 2023*. Whether pollution is released in Australia or overseas, our environment suffers the same consequences.<\/p>\n\n\n\n<p><em>*Climate Council analysis based on <a href=\"https:\/\/climateanalytics.org\/publications\/australias-global-fossil-fuel-carbon-footprint\">Climate Analytics 2024<\/a> and <a href=\"https:\/\/www.dcceew.gov.au\/climate-change\/publications\/national-greenhouse-accounts-2023\/national-inventory-by-economic-sector-data-tables-and-methodology-2023\">DCCEEW 2025<\/a>.<\/em><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"1024\" src=\"https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/epbc-graph-3-1024x1024.jpg\" alt=\"\" class=\"wp-image-170520\" srcset=\"https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/epbc-graph-3-1024x1024.jpg 1024w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/epbc-graph-3-300x300.jpg 300w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/epbc-graph-3-150x150.jpg 150w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/epbc-graph-3-768x768.jpg 768w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/epbc-graph-3-1536x1536.jpg 1536w, https:\/\/www.climatecouncil.org.au\/wp-content\/uploads\/2025\/11\/epbc-graph-3-2048x2048.jpg 2048w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Mega-polluting projects up for approval<\/strong><\/h1>\n\n\n\n<p>The list of projects waiting for approval includes highly-polluting projects like:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Browse gas project,<\/strong> on Scott Reef in WA, which would run for up to 44 years \u2013 to 2070. Browse would produce an average of <a href=\"https:\/\/www.woodside.com\/docs\/default-source\/our-business---documents-and-files\/burrup-hub---documents-and-files\/browse---documents-and-files\/proposed-browse-to-nws-project---supplement-report-to-the-draft-eis-%28epbc-2018-8319%29.pdf?sfvrsn=231f858b_3\">4 million tonnes<\/a> of climate pollution in Australia every year, and up to 6.8 million tonnes at its peak \u2013 more than the annual climate pollution of <a href=\"https:\/\/nexaadvisory.com.au\/coal-performance-in-the-nem-gladstone-power-station\/\">Gladstone<\/a>, Queensland\u2019s oldest and largest coal-fired power station.<\/li>\n\n\n\n<li><strong>Hunter Valley Operations (HVO) Coal Continuation Project,<\/strong> NSW, which would extend the life of one of Australia\u2019s largest coal mines for up to 19 years, directly releasing more than <a href=\"https:\/\/majorprojects.planningportal.nsw.gov.au\/prweb\/PRRestService\/mp\/01\/getContent?AttachRef=SSD-11826621%2120221219T072509.008%20GMT\">1.2 million tonnes<\/a> of climate pollution every year in Australia. This is equal to more than 500,000 extra cars on the road in Australia every year.<\/li>\n\n\n\n<li><strong>Winchester South coal mine<\/strong> in Queensland\u2019s Bowen Basin, which is the largest new coal project proposed in Australia. Its environmental impact assessment documents reveal it would directly release <a href=\"https:\/\/eisdocs.dsdip.qld.gov.au\/Winchester%20South\/Revised%20draft%20EIS\/attachment-12-greenhouse-gas-management-and-abatement-plan.pdf\">more than half a million tonnes<\/a> of climate pollution every year for up to 26 years. This is around 20 times the gross annual emissions of our Pacific neighbour Tuvalu, which is acutely vulnerable to sea level rise caused by climate change and is <a href=\"https:\/\/fossilfueltreaty.org\/\">leading an international campaign<\/a> to end the burning of fossil fuels.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Greenlighting more climate pollution<\/strong><\/h1>\n\n\n\n<p>The Government\u2019s proposed reforms to our national environment law fail to curb climate pollution. Under the proposed reforms, the Environment Minister is not required to consider climate impacts when approving a new project \u2013 no matter how polluting or long-running it is. This is a major climate loophole that would enable more polluting projects to go ahead.<\/p>\n\n\n\n<p>The proposed reforms also don\u2019t require the Minister to consider whether a project is aligned with Australia\u2019s climate targets, policies and international commitments.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.climatecouncil.org.au\/resources\/epbc-fixing-australias-national-environment-law\/\"><strong>Learn more about the climate loopholes in the proposed legislation \u2013 and how the Government can still fix them<\/strong><\/a><\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Putting Australia\u2019s climate targets at risk<\/strong><\/h1>\n\n\n\n<p>Australia has <a href=\"https:\/\/www.climatecouncil.org.au\/resources\/australias-2035-climate-target-is-one-of-the-most-critical-decisions-were-making\/\">just set a target<\/a> of a 62-70% cut in climate pollution by 2035, compared with 2005 levels. The <a href=\"https:\/\/treasury.gov.au\/sites\/default\/files\/2025-09\/p2025-700922.pdf\">Government\u2019s own modelling shows<\/a> that achieving this target is dependent on a large decline in fossil fuel production. However, the Government\u2019s proposed environmental law reforms could <em>directly undermine our ability to reach this target<\/em>, by enabling <em>more<\/em> coal and gas projects to go ahead, and millions more tonnes of climate pollution to be released.&nbsp;<\/p>\n\n\n\n<p>Even a handful of highly polluting projects, like NSW\u2019s HVO coal mine or the Browse gas project could make or break Australia\u2019s 2030 and 2035 targets.&nbsp;<\/p>\n\n\n\n<p>Climate Council analysis has found that if Australia does not cut its fossil fuel production, we will fall short of our 2035 climate target, if other sectors like transport and agriculture do not pick up the slack.&nbsp;<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>The Safeguard Mechanism won\u2019t fix this<\/strong><\/h1>\n\n\n\n<p>The Government claims domestic climate pollution from new or expanded fossil fuel projects is already managed <a href=\"https:\/\/reneweconomy.com.au\/watt-confirms-there-will-be-no-climate-trigger-in-reform-of-epbc-nature-laws\/\">under the Safeguard Mechanism<\/a>. But the Safeguard Mechanism only kicks in after a project is operating \u2013 it doesn\u2019t decide which projects go ahead. Effective policies are needed at both steps: limiting pollution from new and expanding fossil fuel projects, and reducing emissions from existing projects over time, if and when they are approved.&nbsp;<\/p>\n\n\n\n<p><strong>Australia currently has no mechanism to limit pollution from new projects, meaning even projects that are incompatible with Australia\u2019s climate policies, targets, or international obligations can be waved through.&nbsp;<\/strong><\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>No new coal or gas&nbsp;<\/strong><\/h1>\n\n\n\n<p>With nearly all of Australia\u2019s ageing, unreliable coal-fired power stations expected <a href=\"https:\/\/www.climatecouncil.org.au\/understanding-whats-next-for-australias-main-electricity-market\/\">to close by 2038<\/a>, Australia does not need new coal supply for our own energy needs. Most of the coal from these new or expanded projects would be exported.&nbsp;<\/p>\n\n\n\n<p>Gas has a small, shrinking and short-term role to play in Australia\u2019s energy mix, and the vast majority of gas from most recently approved or proposed projects \u2013 including North West Shelf and Browse \u2013 will be exported. Gas from Australia\u2019s existing projects through to 2035 would be enough to meet our domestic energy needs for <a href=\"https:\/\/www.climatecouncil.org.au\/resources\/powering-past-gas-an-energy-strategy-that-works\/\">more than 64 years,<\/a> so there\u2019s no reason to drill for more. Expensive, polluting as is a <a href=\"https:\/\/www.climatecouncil.org.au\/four-reasons-why-your-power-prices-are-sky-high-and-rising\/\">key driver of high power prices<\/a> in Australia \u2013 we need to prioritise reducing our gas use as much as possible, delivering energy bill savings for households and businesses while cutting climate pollution. The expansion of gas extraction in Australia would only add to our climate pollution and increase profits for multinational fossil fuel companies.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Now is your chance to have a say<\/strong><\/h1>\n\n\n\n<p>Right now, the Australian Senate is holding an official inquiry into the Government\u2019s proposed reforms to our national environment law \u2013 the Environmental Protection &amp; Biodiversity Conservation (EPBC) Act.
